1. Agreement to Terms

By accessing or using Banger Ratios ("the Service," "we," "us," or "our") at bangerratios.com, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site. These Terms apply to all users of the site, including without limitation users who are browsers, registered users, and contributors of content.

2. Use of the Service

Banger Ratios is a community platform that allows users to rate music albums on a track-by-track basis and view aggregated community ratings. You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others.

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to any portion of the Service; (c) use automated bots or scrapers to collect data from the Service; (d) submit false, misleading, or fraudulent ratings or content; (e) impersonate any person or entity; or (f) transmit any viruses, malware, or other harmful code.

We reserve the right to terminate or restrict access to the Service for any user who violates these Terms, at our sole discretion and without prior notice.

3. User Accounts

When you create an account with Banger Ratios, you must provide information that is accurate, complete, and current at all times. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 13 years of age to use the Service. If you are under the age of 18, you represent that you have your parent or guardian's permission to use the Service. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information.

4. User Content

By submitting ratings, reviews, comments, usernames, profile information, or any other content ("User Content") to the Service, you grant Banger Ratios a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in connection with operating and improving the Service.

You represent and warrant that: (a) you own or have the rights to submit the User Content; (b) the submission of User Content does not violate any third-party rights; and (c) the User Content does not contain any defamatory, offensive, illegal, or otherwise objectionable material.

5. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Banger Ratios and its operators. Our branding, including the Banger Ratios name, logo, and trademark, may not be used without our prior written consent.

Album artwork, music metadata, and artist information displayed on the Service is sourced from the iTunes Search API and belongs to the respective rights holders. Banger Ratios does not claim ownership of any music or artist content. All music-related intellectual property belongs to the respective artists, labels, and publishers.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. Community ratings on this platform represent the opinions of individual users and do not constitute professional music criticism or endorsement by Banger Ratios.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Banger Ratios and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service. Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is less.

8. Privacy Policy

Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms by reference.

Data We Collect: We collect your email address, username, and music rating data when you create an account. We may also collect basic usage analytics to improve the Service.

How We Use Your Data: We use your email to authenticate your account and send you optional product updates if you have opted in. We use your ratings data to calculate community Banger Ratios and display them on the platform. We do not sell your personal data to third parties.

Data Storage: Your data is stored securely via Supabase. We use industry-standard encryption and security practices. However, no method of transmission over the Internet is 100% secure.

Your Rights: You may request deletion of your account and associated data at any time by contacting us. Upon deletion, your personal information will be removed from our active database, though some information may remain in backups for up to 90 days.

9. Paid Services

Banger Ratios may offer optional paid subscriptions ("Pro" tier) for enhanced features. If you choose to subscribe, you agree to pay the applicable fees as described at the time of purchase. Subscriptions are billed on a recurring basis and will auto-renew unless cancelled. You may cancel your subscription at any time; cancellations take effect at the end of the current billing period. All fees are non-refundable except as required by law.

Payments are processed by Stripe, a third-party payment processor. We do not store your credit card information. Stripe's privacy policy and terms of service govern the processing of your payment information.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Tennessee, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Tennessee.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
